At its 15th session, the General Assembly adopted on 28 September 2021 a “Decision on the monitoring and assessment of legal instruments” and approved the “Explanatory notes on the Decision on the monitoring and assessment of legal instruments.” Monitoring the implementation and application of the Organisation’s legal instruments would provide evidence concerning their usage. Based on the monitoring outcome, assessment of the Organisation’s legal instruments would determine their relevance and any need to revise them.

At its 2nd session, the ad hoc Committee on Legal Affairs and International Cooperation adopted a “Recommendation on involving stakeholders in OTIF’s work”. The Recommendation establishes a transparent, non-discriminatory, inclusive and efficient framework policy for involving stakeholders in the work of OTIF. The proposed form of a recommendation leaves each organ sufficient leeway in terms of how (or if) they wish to implement it.

At its 3rd session, the ad hoc Committee on Legal Affairs and International Cooperation adopted the ‘Guidelines on cooperation with international intergovernmental organisations’. The purpose of these guidelines is to streamline OTIF’s activities and ensure that they are coherent, particularly the activities of its organs and the Secretariat in connection with cooperation with international intergovernmental organisations.

At its 3rd session, the ad hoc Committee on Legal Affairs and International Cooperation adopted the ‘Guidelines on the application of procedures for the modification of COTIF’. The purpose of these guidelines is to provide non-legally binding guidance with the aim of streamlining, standardising and ensuring consistent application of the procedures within the competence of the General Assembly and the Revision Committee for the modification of COTIF established by COTIF and the relevant Rules of Procedure.

At its 5th session, the ad hoc Committee adopted an advisory legal opinion on the interpretation of the CUI UR. It aims to clarify the scope of application of the CUI UR, particularly the term “infrastructure”, with a view to responding to the question of whether the provisions of the CUI UR apply to fixed service facilities within the meaning of Directive 2012/34/EU.
