{"id":260,"date":"2016-07-11T15:14:57","date_gmt":"2016-07-11T15:14:57","guid":{"rendered":"http:\/\/otif.ch\/en\/?page_id=260"},"modified":"2024-10-30T21:15:09","modified_gmt":"2024-10-30T21:15:09","slug":"working-documents","status":"publish","type":"page","link":"https:\/\/otif.org\/test\/de\/?page_id=260","title":{"rendered":"Depositarmitteilungen"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h3 style=\"text-align: left;\">Depositarmitteilungen<br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"alignnone\" src=\"\/fileadmin\/images\/icons\/line.png\" width=\"800\" height=\"1\" \/><\/h3>\n<p>Depositar des \u00dcbereinkommens \u00fcber den internationalen Eisenbahnverkehr (COTIF) ist der Generalsekret\u00e4r bzw. die Generalsekret\u00e4rin. Die Aufgaben des Depositars entsprechen den in Teil VII des Wiener \u00dcbereinkommens vom 23. Mai 1969 \u00fcber das Recht der Vertr\u00e4ge aufgef\u00fchrten.<\/p>\n<p>Die Aufgaben des Depositars haben internationalen Charakter und m\u00fcssen unparteiisch wahrgenommen werden (Artikel 76 \u00a7 2 Wiener \u00dcbereinkommen). Gem\u00e4\u00df Artikel 77 \u00a7 1 des Wiener \u00dcbereinkommens umfassen die Aufgaben eines Depositars insbesondere folgende Punkte:<\/p>\n<ul>\n<li>Verwahrung der Urschrift des Vertrags und der dem Verwahrer \u00fcbergebenen Vollmachten;<\/li>\n<li>Erstellung beglaubigter Abschriften der Urschrift sowie weiterer Texte des Vertrags in den nach dem Vertrag erforderlichen zus\u00e4tzlichen Sprachen und \u00dcbermittlung an die Vertragsparteien und die Staaten, die berechtigt sind, Vertragsparteien zu werden;<\/li>\n<li>Entgegennahme und Verwahrung von Unterzeichnungen des Vertrags sowie aller sich auf den Vertrag beziehenden Urkunden, Notifikationen und Mitteilungen;<\/li>\n<li>Pr\u00fcfung, ob die Unterzeichnung und jede sich auf den Vertrag beziehende Urkunde, Notifikation oder Mitteilung in guter und geh\u00f6riger Form sind, und, falls erforderlich, den betreffenden Staat darauf aufmerksam zu machen;<\/li>\n<li>Unterrichtung der Vertragsparteien sowie der Staaten, die berechtigt sind, Vertragsparteien zu werden, \u00fcber Handlungen, Notifikationen und Mitteilungen, die sich auf den Vertrag beziehen;<\/li>\n<li>Unterrichtung der Staaten, die berechtigt sind, Vertragsparteien zu werden, \u00fcber den Zeitpunkt, zu dem die f\u00fcr das Inkrafttreten des Vertrags erforderliche Anzahl von Unterzeichnungen oder von Ratifikations\u2011, Annahme\u2011, Genehmigungs- oder Beitrittsurkunden vorliegt oder hinterlegt wurde;<\/li>\n<li>Registrierung des Vertrags beim Sekretariat der Vereinten Nationen;<\/li>\n<li>Erf\u00fcllung der in anderen Bestimmungen des Wiener \u00dcbereinkommens bezeichneten Aufgaben.<\/li>\n<\/ul>\n<p>Depositarmitteilungen sind formelle Mitteilungen, durch die der Depositar, die COTIF-Parteien \u00fcber den Status und die Rechtsakte des \u00dcbereinkommens unterrichtet.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_tta_accordion color=&#8221;white&#8221; active_section=&#8221;100&#8243;][vc_tta_section title=&#8221;2024&#8243; tab_id=&#8221;1720606783784-ccd00670-de26&#8243;][vc_column_text css=&#8221;&#8221;]<\/p>\n<table style=\"width: 44.9404%; height: 574px;\" width=\"0\">\n<tbody>\n<tr style=\"height: 48px;\">\n<td style=\"height: 48px; text-align: left;\" width=\"113\"><span style=\"font-size: 10pt;\"><a href=\"http:\/\/otif.org\/fileadmin\/new\/2-Activities\/Depositary\/NOT-24004-d-Beitritt_Moldau-Antrag.pdf\">NOT-24004<\/a> <\/span><\/td>\n<td style=\"height: 48px; text-align: left;\" width=\"104\"><span style=\"font-size: 10pt;\">26.
