de d\u00e9velopper davantage les transports ferroviaires. Le Protocole de Luxembourg r\u00e9pond \u00e0 ce besoin de d\u00e9veloppement. Son but est en effet de faciliter les financements provenant du secteur priv\u00e9 \u2013 plus nombreux et \u00e0 moindre co\u00fbt \u2013 pour l\u2019acquisition du mat\u00e9riel roulant, permettant ainsi aux gouvernements d\u2019affecter leurs ressources \u00e0 l\u2019infrastructure.<\/p><p>\u00a0<\/p><p>Le Protocole de Luxembourg \u00e9tablit un nouveau syst\u00e8me juridique g\u00e9n\u00e9ral pour la reconnaissance et la hi\u00e9rarchisation de trois types de garanties d\u00e9tenues par des cr\u00e9anciers sur le mat\u00e9riel roulant ferroviaire. Il garantit\u00a0: un bailleur sous bail, un cr\u00e9ancier sous pr\u00eat garanti et les droits d\u2019un vendeur dans une vente conditionnelle (o\u00f9 le titre est conserv\u00e9).<\/p><p>\u00a0<\/p><p>Les garanties seront enregistr\u00e9es dans un nouveau\u00a0<a href=\"https:\/\/rollingstockregistry.com\/\" target=\"_blank\" rel=\"noopener\">registre international des garanties sur le mat\u00e9riel roulant<\/a>, qui sera consultable par le public 24\u00a0h\u00a0\/\u00a024 et 7\u00a0j\u00a0\/\u00a07.<\/p><p>\u00a0<\/p><p>Le conservateur du registre et l\u2019exploitation du registre international sont supervis\u00e9s par l\u2019Autorit\u00e9 de surveillance, organisation internationale dot\u00e9e de la personnalit\u00e9 juridique internationale en vertu de l\u2019article\u00a027, \u00a7\u00a01, de la Convention relative aux garanties internationales portant sur des mat\u00e9riels d\u2019\u00e9quipement mobiles.
